Where Edmonds Residents File Family Court Cases

All family law cases for Edmonds residents go to the Snohomish County Superior Court. That court is located at 3000 Rockefeller Avenue in Everett, about 15 miles north of Edmonds. The County Clerk's office in the same building keeps all case files and handles public records requests. The clerk's office is open Monday through Friday from 8:30 a.m. to 4:30 p.m. and is closed from noon to 12:45 p.m. for lunch.

Snohomish County Superior Court has jurisdiction over dissolution, legal separation, custody, child support, and protection orders for all Snohomish County cities including Edmonds. For dissolution cases, Washington law requires that at least one party be a resident of the state at the time of filing. There is no county-specific residency waiting period before you can file.

Copy fees at the clerk's office are $0.25 per page for plain copies. Certified copies are $5.00 for the first page and $1.00 for each additional page. If you need audio of a court hearing, that costs $25 per hearing date. The public access area in Room M-206 lets you view records on-site at no charge.

Filing a Family Law Case in Edmonds

Edmonds residents who want to file for dissolution, custody, or other family law relief do so through the Snohomish County Superior Court. Washington is a no-fault state. The only ground for dissolution is that the marriage is irretrievably broken. You do not need to prove fault or wrongdoing. The governing statute is RCW Chapter 26.09, which covers the full process from filing through final order entry.

The process starts when one party files a Petition for Dissolution with the clerk. The other party must be formally served or must sign a Joinder. After service, Washington requires a 90-day waiting period before the court can enter a final decree. Agreed cases can proceed to finalization as soon as that period ends. Contested matters may take longer and could involve hearings, mediation, and discovery.

Cases with minor children require parenting plans and child support calculations under state guidelines. Snohomish County requires both parents to complete a parenting seminar when children are involved in a dissolution or custody case. That seminar must be done before the final order is entered in most situations.

Note: Washington's 90-day waiting period begins when the petition is filed and the other party is formally served. Filing earlier starts that clock sooner.

Edmonds Municipal Court - Limited Jurisdiction

Edmonds has its own municipal court, but it does not handle family law cases. The Edmonds Municipal Court only has jurisdiction over misdemeanor and gross misdemeanor criminal cases, traffic infractions, civil infractions, and city code violations within Edmonds city limits. Judge Neil Weiss presides over the Edmonds Municipal Court.

If you are dealing with a domestic violence charge or a protection order, that may involve either the municipal court (for the criminal side) or the Superior Court (for the civil protection order side). Dissolution, custody, and child support cases always go to Superior Court, not to the Edmonds Municipal Court.
