Filing a Family Law Case in Marysville

Marysville residents file dissolution and other family law matters at Snohomish County Superior Court. Washington is a no-fault state. The only ground for dissolution is that the marriage is irretrievably broken. You do not need to show fault or wrongdoing by either party. The dissolution process is governed by RCW Chapter 26.09, which covers everything from filing procedures to property division, maintenance, and parenting plans.

To file, you start by submitting a Petition for Dissolution and a Summons at the clerk's office. The other party must be formally served or must join voluntarily. After service is complete, Washington requires a mandatory 90-day waiting period. This period must pass before the court can enter the final dissolution decree. Cases where both parties agree on all terms can wrap up quickly after the 90 days. Disputed matters may take considerably longer.

Child abuse and neglect issues in family court cases are governed by RCW Chapter 26.44, which establishes the duty to report and court procedures for protective action. When child welfare concerns arise in a Marysville case, the court may appoint a guardian ad litem to independently represent the children's interests.

Cases with minor children require parenting plans and child support worksheets. Snohomish County requires both parents to complete a parenting seminar before the final order is entered. That requirement exists in almost all contested and some uncontested cases involving children.

Note: Washington's 90-day waiting period begins when the petition is filed and formally served on the other party. The sooner you file, the sooner that clock starts.
